It’s up to the studio. The studio I think is reluctant to pull the trigger on such a hard rated-R script. Then the guys who wrote it, and the producers, won’t make it unless it’s that hard and, you know, raunchy.
Its unfortunate to hear that Fox isn’t playing ball, but very nice to see that the writers and producers are sticking to their guns, its the very least they can do to help make up for the terrible portrayal of the character at the end of X-Men Origins: Wolverine.
Hopefully we will see something sooner rather than later, but if Fox’s track record indicates anything, its likely we may never see this movie in the way it deserves to be made.
